What is overcrowding housing?

Whether or not you are ‘overcrowded’ will depend on the size and occupancy of your home. There are two standards in Part X of the Housing Act 1985 which are used to assess whether a home is statutorily overcrowded. If either or both standards are breached, a dwelling will be statutorily overcrowded. The accommodation will not be ‘adequate’ if it is or it will be overcrowded.

The overcrowding standards are generally governed by the following regulations: Sections 324-326 of the Housing Act 1985 ; Sections 135 to 137 of Part VII of the Housing (Scotland) Act 1987 ; The Housing (Northern Ireland) Order 1988 or Section 76 of The Housing (Northern Ireland) Order 1992 No. 1725 (NI. 15).

By the number of rooms for people to sleep in. This is called the room standard.

The number of person units may not be the same as the number of people. Children less than 1 year count as 0 units, children over 1 and under 10 count as half a unit and children and adults over 10 count as one unit.

The permitted number of persons in relation to a dwelling is whichever is the less of—

(b) the aggregate for all such rooms in the dwelling of the numbers specified in column 2 of Table II in relation to each room of the floor area specified in column 1

No account shall be taken for the purposes of either Table of a room having a floor area of less than 50 square feet.
