Appendix FM of the Immigration Rules requires that a person applying to enter the United Kingdom as a parent or settled sponsors’ of an adult dependent relative or adopted child provide specified evidence that they can ‘adequately’ maintain and accommodate without recourse to public funds.

Assessing Adequate Accommodation For Spouse Visa

The ECO should be satisfied that the accommodation complies with the following requirements:

  • it is capable of accommodating the couple, and any children, without overcrowding as defined in the Housing Act 1985
  • Under Section 604 of the Housing Act 1985 (as amended) the property is fit for human habitation.

Accommodation is not adequate if it is, or will be, overcrowded. Under paragraph 6 of the Immigration Rules, the meaning of overcrowded is the meaning in the Housing Act 1985, the Housing (Scotland) Act 1987 or the Housing (Northern Ireland) Order 1988 (as appropriate).

Accommodation is not adequate if it does or will contravene public health
regulations.
